If you want to make an offer at the court hearing, YOU NEED TO DO THE FOLLOWING:

 

1.) Print off and attached a signed copy of schedule A to the purchase offer. This document clearly spells out all the items that the lender is not responsible for (my client). Understand what "As Is, Where Is" means

 

2.) Offer Not to include any chattels, the range and hood will not go with the sale of the property.

 

3.) Completion/adjustment/possession for the owner is "30 days after Court Approval"

 

4.) The court will not approve any offer with a "subject"

 

5.) The Court will not approve any offer without a significant and real deposit (i.e. usually 5% in the form of a bank draft or certified check, either deposited in a REALTOR's or Lawyers trust account.

 

6.) There is no PCDS for this court order sale.

 

7.) The Court will not approve any offer without the full and proper name(s) of the purchaser(s) exactly as such name(s) will appear in title if that offer is successful bid). So an offer with the words "or nominee" or anything similar would not be approved. Once the offer is approved, the name(s) cannot be changed in any way... or without considerable expense and delay of a further application to the Court.
